This resource is for advisors and representatives of inter\/national organizations participating in the student organization conduct process. Investigation timelines vary based on the type of investigation and cooperation from the student organization.<\/li>\n<li>An outcome is determined.\n<ul>\n<li>A No Action Determination means the case is closed with no charges.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p style=\"padding-left: 80px\"><strong><span style=\"text-decoration: underline\">OR<\/span><\/strong><\/p>\n<ol>\n<li style=\"list-style-type: none\">\n<ul>\n<li>A Finding of Responsibility &amp; Sanction Recommendations includes:<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none\">\n<ul>\n<li style=\"list-style-type: none\">\n<ul>\n<li>Notice of Allegations (investigation summary) shared with key stakeholders<\/li>\n<li>Follow-up meeting with key stakeholders to discuss potential sanctions\/outcomes<\/li>\n<li>Sanction recommendations are shared with the organization &amp; all respective stakeholders<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<a href=\"https:\/\/studentlife.utk.edu\/studentconduct\/wp-content\/uploads\/sites\/12\/2018\/08\/Student-Organization-Conduct-Process-Summary-REVISED.pdf\" class=\"btn btn-default btn-orange btn-lg btn-block\">Student Organization Conduct Process<\/a>\n<p><\/div><\/div><\/div><\/p>\n<hr class=\"orange-hash\">\n<h2><strong>Resources for<\/strong><strong> Local Advisors through the Conduct Process<\/strong><\/h2>\n<p>The support of local advisors is an integral part of the success of student organizations. During the conduct process, local advisors can help provide important historical context on the organization and are an essential supportive measure for the student representatives.<\/p>\n<p><strong><div class=\"panel  panel panel-default\"><div class=\"panel-heading\"><h3 class=\"panel-title\"><a class=\"collapsed\" data-toggle=\"collapse\" data-parent=\"#single-collapse\"\" href=\"#single-collapse-1\"  aria-expanded=\"true\" aria-controls=\"#single-collapse-1\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"icon-collapse\" viewBox=\"0 0 24 24\"><path d=\"M0 7.33l2.829-2.83 9.175 9.339 9.167-9.339 2.829 2.83-11.996 12.17z\"\/><\/svg> Local Advisors in Educational Conferences<\/a><\/h3><\/div><div id=\"single-collapse-1\" class=\"panel-collapse collapse panel-collapse collapse\"><div class=\"panel-body\"><\/strong> Local advisors are permitted, and encouraged, to attend Education Conferences and follow-up meetings between a student organization and SCCS, as an &#8220;Advisor,&#8221; as defined in Section 5.3 of the Code. Please note that advisors are not permitted to speak for or on behalf of a respondent\/student organization. <\/div><\/div><\/div><\/p>\n<p><strong><div class=\"panel  panel panel-default\"><div class=\"panel-heading\"><h3 class=\"panel-title\"><a class=\"collapsed\" data-toggle=\"collapse\" data-parent=\"#single-collapse\"\" href=\"#single-collapse-2\"  aria-expanded=\"true\" aria-controls=\"#single-collapse-2\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"icon-collapse\" viewBox=\"0 0 24 24\"><path d=\"M0 7.33l2.829-2.83 9.175 9.339 9.167-9.339 2.829 2.83-11.996 12.17z\"\/><\/svg> Local Advisors' Participation in Conduct Cases<\/a><\/h3><\/div><div id=\"single-collapse-2\" class=\"panel-collapse collapse panel-collapse collapse\"><div class=\"panel-body\"><\/strong>\u00a0Local advisors are encouraged to participate in the student organization conduct process as follows:<\/p>\n<ul>\n<li>Review the Student Code of Conduct<\/li>\n<li>Review all notices and documents sent by SCCS to the student organization<\/li>\n<li>Attend all initial and follow-up meetings scheduled with SCCS and the student organization<\/li>\n<li>Provide support to the student organization, its president or identified representative, and members<\/li>\n<li>Promote honest, forthcoming, and prompt communication by the student organization, through its president, representatives, and members<\/li>\n<li>Strive for a fair and amicable resolution between the organization and SCCS <\/div><\/div><\/div><\/li>\n<\/ul>\n<p><strong><div class=\"panel  panel panel-default\"><div class=\"panel-heading\"><h3 class=\"panel-title\"><a class=\"collapsed\" data-toggle=\"collapse\" data-parent=\"#single-collapse\"\" href=\"#single-collapse-3\"  aria-expanded=\"true\" aria-controls=\"#single-collapse-3\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"icon-collapse\" viewBox=\"0 0 24 24\"><path d=\"M0 7.33l2.829-2.83 9.175 9.339 9.167-9.339 2.829 2.83-11.996 12.17z\"\/><\/svg> Scheduled Meetings<\/a><\/h3><\/div><div id=\"single-collapse-3\" class=\"panel-collapse collapse panel-collapse collapse\"><div class=\"panel-body\"><\/strong> To promptly resolve conduct cases, SCCS will schedule meetings consistent with students&#8217; class schedules and their availability. Advisors should consult with Student Representative to determine meeting time(s). They may teleconference in if unable to attend in person. <\/div><\/div><\/div><\/p>\n<hr class=\"orange-hash\">\n<h2><strong>Resources for<\/strong> i<strong>nter\/national organizations <\/strong><strong>through the conduct process<\/strong><\/h2>\n<p>The University of Tennessee believes in an active partnership with key stakeholders to best address issues of misconduct. Inter\/national organizations and\/or regional representatives are an integral part of addressing and investigating misconduct. SCCS prioritizes partnering with stakeholders through communication and collaboration. In the spring of 2022, SCCS made intentional efforts to revise and strengthen collaboration with inter\/national headquarters. As such, SCCS sends annual correspondence to inter\/national organizations detailing our partnership and collaborative approach to student organization misconduct. The initial letter detailing the change is linked below:<\/p>\n<p><a href=\"https:\/\/studentlife.utk.edu\/studentconduct\/wp-content\/uploads\/sites\/12\/2024\/08\/UTK-Collaboration-Letter-to-Inter-National-Organizations.pdf\" target=\"_blank\" rel=\"noopener\">UT Collaboration Letter to Inter\/National Organizations<\/a><\/p>\n<p>SCCS is always looking for new avenues to improve and adapt the current partnership model. If you have suggestions about how SCCS could improve partnership throughout the conduct process, please contact SCCS.<\/p>\n<p><strong><strong><div class=\"panel  panel panel-default\"><div class=\"panel-heading\"><h3 class=\"panel-title\"><a class=\"collapsed\" data-toggle=\"collapse\" data-parent=\"#single-collapse\"\" href=\"#single-collapse-4\"  aria-expanded=\"true\" aria-controls=\"#single-collapse-4\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"icon-collapse\" viewBox=\"0 0 24 24\"><path d=\"M0 7.33l2.829-2.83 9.175 9.339 9.167-9.339 2.829 2.83-11.996 12.17z\"\/><\/svg> Notification to Inter\/National Organizations<\/a><\/h3><\/div><div id=\"single-collapse-4\" class=\"panel-collapse collapse panel-collapse collapse\"><div class=\"panel-body\"> <\/strong><\/strong>Student Conduct &amp; Community Standards notifies an inter\/national organization and\/or regional representative, along with the organization\u2019s advisor, of an alleged violation of the Student Code of Conduct through a written notice of Educational Conference.<\/p>\n<ul>\n<li>When the nature of the incident is more severe, SCCS or the organization\u2019s administrative liaison reserves the right to immediately contact the inter\/national organization. University interim administrative action may also be taken at any point in an investigation.<\/li>\n<\/ul>\n<p><\/div><\/div><\/div><\/p>\n<div class=\"panel  panel panel-default\"><div class=\"panel-heading\"><h3 class=\"panel-title\"><a class=\"collapsed\" data-toggle=\"collapse\" data-parent=\"#single-collapse\"\" href=\"#single-collapse-5\"  aria-expanded=\"true\" aria-controls=\"#single-collapse-5\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"icon-collapse\" viewBox=\"0 0 24 24\"><path d=\"M0 7.33l2.829-2.83 9.175 9.339 9.167-9.339 2.829 2.83-11.996 12.17z\"\/><\/svg> <strong>Partnering through Interim Action<\/strong><\/a><\/h3><\/div><div id=\"single-collapse-5\" class=\"panel-collapse collapse panel-collapse collapse\"><div class=\"panel-body\"><\/p>\n<p>When the nature of an incident is more severe and\/or the student organization\u2019s continued presence poses a significant risk of substantial harm to the health, safety, or welfare of others, interim administrative action may be imposed by the Vice Chancellor for Student Life. University interim administrative action may be taken at any point in an investigation. Generally, SCCS, or the organization\u2019s administrative liaison, will contact the inter\/national organization prior to Interim Action being imposed. Wherever possible, SCCS works with inter\/national organizations to craft language to recommend to the Vice Chancellor that feels appropriate based on the allegations and keeps the members and community at large safe.<\/p>\n<p>In the event that an inter\/national organizations becomes aware of new information and imposes internal interim action, the university will generally mirror the restrictions. Please notify SCCS at <a href=\"mailto:studentconduct@utk.edu\">studentconduct@utk.edu<\/a> or 865-974-3171 if your organization becomes aware of concerning behavior and may impose interim action in response to an incident.<\/p>\n<p><\/div><\/div><\/div>\n<div class=\"panel  panel panel-default\"><div class=\"panel-heading\"><h3 class=\"panel-title\"><a class=\"collapsed\" data-toggle=\"collapse\" data-parent=\"#single-collapse\"\" href=\"#single-collapse-6\"  aria-expanded=\"true\" aria-controls=\"#single-collapse-6\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"icon-collapse\" viewBox=\"0 0 24 24\"><path d=\"M0 7.33l2.829-2.83 9.175 9.339 9.167-9.339 2.829 2.83-11.996 12.17z\"\/><\/svg> <strong>Partnering through the Conduct Process<\/strong><\/a><\/h3><\/div><div id=\"single-collapse-6\" class=\"panel-collapse collapse panel-collapse collapse\"><div class=\"panel-body\"><\/p>\n<ul>\n<li><strong>Notification<\/strong>: When the nature of the incident is more severe, SCCS, or the organization\u2019s administrative liaison, may immediately contact the inter\/national organization to notify the group, discuss any need for interim action, and connect on an investigation plan.<\/li>\n<li><strong>Participating in Witness Meetings:<\/strong> If a FERPA waiver is on file for a member, an inter\/national organization or regional headquarters may participate in SCCS meetings and interviews with members of the student organization.<\/li>\n<li><strong>Collaborating on Investigation Summary:<\/strong> SCCS will often share the Notice of Allegations with the inter\/national organization prior to meeting with the student organization. The inter\/national organization can provide feedback and utilize the information included to draft any outcomes from the inter\/national organization lens.<\/li>\n<li><strong>Collaborating on Sanction Recommendations:<\/strong> If SCCS determines it is more likely than not that the student organization violated the Code, SCCS will often work with representatives from the inter\/national organization on the recommended sanctions. Inter\/national organizations often have educational programming that is specific to their organization and can create more buy-in for the members. SCCS also values input around any administrative outcomes, including social restrictions. SCCS generally tries to align all recommended outcomes with any outcomes the inter\/national organization is also imposing.<\/li>\n<\/ul>\n<p><\/div><\/div><\/div>\n<hr class=\"orange-hash\">\n<h2>Requesting Individual Member Disciplinary Checks<\/h2>\n<p>SCCS has the ability to work with organizations to provide disciplinary records of their individual members to the organization&#8217;s advisors, inter\/national organization, and\/or regional representatives. To provide this information, the students must have completed a Family Educational Rights and Privacy Act (FERPA) waiver. FERPA does not apply to student organizations, but rather only to individual students.<\/p>\n<p>The Office of Sorority &amp; Fraternity Life requests that all incoming members sign a FERPA waiver when they accept membership into their chosen organization. The Center for Student Engagement and RecSports do not have the same requirements.<\/p>\n<p>To request a disciplinary check for your organization&#8217;s members, please email SCCS at <a href=\"mailto:studentconduct@utk.edu\">studentconduct@utk.edu<\/a>.
