Respondents and Complainants engaged in the student conduct process have the right to be assisted by an advisor during all stages of the student conduct process. Student Conduct and Community Standards (SCCS) encourages students who choose to be assisted by an advisor to consider selecting a University employee or student who has received training from SCCS about the student conduct process. At their own expense, the Complainant and Respondent may choose a person not employed by the university to serve as an advisor (e.g., friend, attorney).<\/p>\n

Role of an Advisor<\/h2>\n

The role of an Advisor is limited to assisting, advising, and\/or supporting a Complainant or Respondent during the student conduct process. An Advisor is not permitted to speak for or on behalf of a Complainant or Respondent, appear in lieu of a Complainant or Respondent, participate as a witness, or participate directly in any other manner during any phase of the student conduct process, except in Title IX Hearing.<\/p>\n

Notice of the Right to Have an Advisor<\/h2>\n

SCCS provides written notice to the Complainant and the Respondent of their rights to an Advisor. Full details regarding the right to an Advisor can found in Section 5.3 of the Code of Conduct.<\/p>\n

Students identified as Witnesses in the student conduct process are not afforded the Fundamental Rights provided to Complainants and Respondents. Therefore, Witnesses do not have the right to an Advisor for the purpose of participating in the student conduct process.<\/p>\n

Family Educational Rights and Privacy Act (FERPA)<\/h2>\n

In order for the University to communicate with an Advisor about a student\u2019s educational record, the student must submit a FERPA waiver, which is an authorization to release information.
