We even practice consent non-verbally, like when we open our arms, non-verbally asking for a hug, and the other person gives us a non-verbal signal that they&nbsp;don\u2019t&nbsp;want a hug.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consent is always important, but it is\u202f<em>especially\u202f<\/em>important when it comes to sexual activity.<\/p>\n<\/div>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-002ffff5 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\">Consent is Required<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As defined by the University of Tennessee\u2019s&nbsp;<a href=\"https:\/\/titleix.utk.edu\/title-ix-policy\/\" target=\"_blank\" rel=\"noreferrer noopener\">Policy on Sexual Harassment, Sexual Assault, Dating and Domestic Violence, and Stalking<\/a>, consent is \u201can active agreement to participate in a sexual act.\u201d&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-utk-wds-accordion\"><div data-accordion=\"true\" class=\"utk-wds-accordion-wrapper\" data-color-scheme=\"medium\">\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>What is an active agreement?<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\">An&nbsp;<strong>active agreement<\/strong>&nbsp;is defined as words and\/or conduct that communicate a person\u2019s willingness to&nbsp;participate&nbsp;in a sexual act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>words<\/strong>&nbsp;= spoken, written, or signed language&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>conduct\u202f<\/strong>= non-verbal body language, movements, or behaviors&nbsp;<\/p>\n<\/div><\/section><\/div>\n\n\n\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>What&nbsp;is a sexual act?&nbsp;<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\">A&nbsp;<strong>sexual act\u202f<\/strong>can include any of the following, without limitation:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>vaginal intercourse (penile-vaginal intercourse)&nbsp;<\/li>\n\n\n\n<li>anal intercourse (penile-anal intercourse)&nbsp;<\/li>\n\n\n\n<li>oral sex (mouth-to-genitals or mouth-to-anus)&nbsp;<\/li>\n\n\n\n<li>any other intrusion, however slight, of a person\u2019s finger (i.e., digital penetration) or any other object into any other person\u2019s genitals or anus&nbsp;<\/li>\n\n\n\n<li>the intentional touching of a person\u2019s intimate parts (genital area, groin, inner thigh, buttock, or breast)&nbsp;<\/li>\n\n\n\n<li>the intentional touching of the clothing covering the immediate area of a person\u2019s intimate parts&nbsp;<\/li>\n\n\n\n<li>the intentional touching of any other person with that person\u2019s own intimate parts, if that touching can be&nbsp;reasonably construed&nbsp;as being for the purpose of sexual gratification&nbsp;<\/li>\n<\/ul>\n<\/div><\/section><\/div>\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Consent is&nbsp;<strong>always required<\/strong>&nbsp;to engage in sexual activity with someone. If sexual activity happens without consent, it\u2019s <a href=\"https:\/\/studentlife.utk.edu\/wellness\/sexual-misconduct\/\" id=\"108\">sexual assault<\/a>.<\/p>\n<\/div>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-002ffff5 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\">Components of Consent<\/h2>\n\n\n\n<div class=\"wp-block-utk-wds-accordion\"><div data-accordion=\"true\" class=\"utk-wds-accordion-wrapper\" data-color-scheme=\"light\">\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>Consent is Clear.<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Clear<\/strong>&nbsp;(<em>adjective<\/em>) \u2013&nbsp;easy to perceive, understand, or interpret<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should be abundantly clear if someone has given consent or not.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clear consent can be a mixture of affirmative verbal and non-verbal messages. (The presence or absence of consent is evaluated based on the totality of circumstances. This is not an exhaustive list of&nbsp;examples.)\u2028<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Signs of Clear Consent<\/strong><\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-002ffff5 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<ul class=\"wp-block-list\">\n<li>Saying things like:\n<ul class=\"wp-block-list\">\n<li>Yes!<\/li>\n\n\n\n<li>I&#8217;m sure.<\/li>\n\n\n\n<li>Don&#8217;t stop.<\/li>\n\n\n\n<li>I like that. <\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<ul class=\"wp-block-list\">\n<li>Nodding head &#8220;yes&#8221;<\/li>\n\n\n\n<li>Initiating sexual activity<\/li>\n\n\n\n<li>Reciprocating and progressing sexual activity&nbsp;<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n<\/div>\n<\/div><\/section><\/div>\n\n\n\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>Consent is Mutual.<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Mutual<\/strong>&nbsp;(<em>adjective<\/em>) \u2013&nbsp;(of a feeling or action) experienced or done by each of two or more parties toward the other(s); held in common by two or more parties<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Communicating consent is the responsibility of&nbsp;<strong>all<\/strong>&nbsp;parties involved. It is a mutual responsibility.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both the&nbsp;<strong>ask&nbsp;<\/strong>for sexual activity and the&nbsp;<strong>answer<\/strong>&nbsp;should be&nbsp;<strong>clear<\/strong>.&nbsp;<\/p>\n<\/div><\/section><\/div>\n\n\n\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>Consent is Ongoing.<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Ongoing\u202f<\/strong>(<em>adjective<\/em>) \u2013&nbsp;continuing; still in progress<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consent is <strong>never<\/strong>&nbsp;a one-time thing. It is an ongoing process.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is important that partners continually check in with one another during&nbsp;a sexual&nbsp;interaction.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no such thing as&nbsp;blanket&nbsp;consent.&nbsp;<\/p>\n<\/div><\/section><\/div>\n\n\n\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>Consent is Revocable.<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Revocable<\/strong>&nbsp;(<em>adjective<\/em>) \u2013&nbsp;capable of being revoked (canceled, taken back, withdrawn)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">People are allowed to change their minds.&nbsp;A person who has given consent can revoke that consent.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once consent is revoked, the activity must&nbsp;<strong>stop<\/strong>.&nbsp;<\/p>\n<\/div><\/section><\/div>\n\n\n\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>Consent is Specific.<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Specific<\/strong>&nbsp;(<em>adjective<\/em>) \u2013&nbsp;clearly defined or identified&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The sexual activities one&nbsp;wants&nbsp;to engage in with their partner(s) should be clearly specified.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Our language should also be clear and specific.&nbsp;<\/p>\n<\/div><\/section><\/div>\n\n\n\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>Consent is Informed.<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Informed<\/strong>&nbsp;(<em>adjective<\/em>) \u2013&nbsp;(of a decision or judgment) based on an understanding of the facts of the situation<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person should\u202f<strong>know\u202f<\/strong>what they are getting into. This includes:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Specific behaviors one does or does not want to engage in.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If one has any sexually transmitted infections (STIs;&nbsp;see the \u201csexual exploitation\u201d section of the&nbsp;<a href=\"https:\/\/titleix.utk.edu\/title-ix-policy\/policy-definitions\/\" target=\"_blank\" rel=\"noreferrer noopener\">Title IX Policy<\/a>).&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Any other information that would inform one\u2019s decision to consent or not.&nbsp;<\/p>\n<\/div><\/section><\/div>\n\n\n\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>Consent is Voluntary.<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Voluntary&nbsp;<\/strong>(<em>adjective<\/em>) \u2013&nbsp;done, given, or acting of one\u2019s own free will<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision about<s> <\/s>whether&nbsp;to&nbsp;engage in sexual activity, when, with whom, and under what conditions is a&nbsp;<strong>personal<\/strong> one.&nbsp;Consent is something that is only <strong>voluntary<\/strong>, not something that can be coerced or forced.&nbsp;<\/p>\n<\/div><\/section><\/div>\n<\/div><\/div>\n<\/div>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-002ffff5 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\">What is Non-Consent<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">What does non-consent&nbsp;look and sound&nbsp;like?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(The presence or absence of consent is evaluated based on the totality of circumstances. This is not an exhaustive list of&nbsp;examples.)<\/p>\n\n\n\n<div class=\"wp-block-utk-wds-accordion\"><div data-accordion=\"true\" class=\"utk-wds-accordion-wrapper\" data-color-scheme=\"light\">\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>Signs of <em>No<\/em> Consent<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-002ffff5 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<ul class=\"wp-block-list\">\n<li>Saying things like:&nbsp;\n<ul class=\"wp-block-list\">\n<li>No&nbsp;<\/li>\n\n\n\n<li>Stop&nbsp;<\/li>\n\n\n\n<li>I&nbsp;don\u2019t&nbsp;want to<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<ul class=\"wp-block-list\">\n<li>Trying to leave the situation&nbsp;<\/li>\n\n\n\n<li>Fighting back&nbsp;<\/li>\n\n\n\n<li>Being incapacitated&nbsp;<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div><\/section><\/div>\n\n\n\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>Signs to <em>Pause<\/em> and<em> Seek Clarity<\/em><\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\">If one feels like they are getting mixed signals or are unsure whether they have received consent, that is a sign to pause and seek clarity. Signs to pause include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Verbal and non-verbal communication&nbsp;doesn\u2019t&nbsp;match;&nbsp;<\/li>\n\n\n\n<li>One thinks they are getting non-verbal consent, but&nbsp;aren\u2019t&nbsp;100%&nbsp;sure;&nbsp;<\/li>\n\n\n\n<li>No verbal or non-verbal communication has been given.&nbsp;<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-002ffff5 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<ul class=\"wp-block-list\">\n<li>Saying things like:&nbsp;\n<ul class=\"wp-block-list\">\n<li>I\u2019m&nbsp;not sure&nbsp;<\/li>\n\n\n\n<li>I want to, but\u2026&nbsp;<\/li>\n\n\n\n<li>Maybe&nbsp;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<ul class=\"wp-block-list\">\n<li>Not reciprocating or progressing sexual activity&nbsp;<\/li>\n\n\n\n<li>Seems checked out or uncomfortable&nbsp;<\/li>\n\n\n\n<li>Tense or stiff body language&nbsp;<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div><\/section><\/div>\n<\/div><\/div>\n<\/div>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h2 class=\"wp-block-heading\">Who Cannot Give Consent<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A person who is&nbsp;<strong>incapacitated.<\/strong><\/li>\n\n\n\n<li>A person who is&nbsp;<strong>forced.<\/strong><\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-utk-wds-accordion\"><div data-accordion=\"true\" class=\"utk-wds-accordion-wrapper\" data-color-scheme=\"light\">\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>What is incapacitation?<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Incapacitation&nbsp;<\/strong>means that a person lacks the ability to actively agree to sexual activity because the person is asleep, unconscious, under the influence of an anesthetizing or&nbsp;intoxicating substance such that the person does not have control over their body, is otherwise unaware that sexual activity is occurring, or their mental, physical, or developmental abilities render&nbsp;them incapable of making a rational, informed judgment.\u202f <strong>Incapacitation is&nbsp;not the same as&nbsp;legal intoxication.<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A person violates this&nbsp;policy when they engage in sexual activity with another person who is&nbsp;incapacitated&nbsp;under circumstances in which&nbsp;a reasonable person would have known the other person to be incapacitated.<\/strong>\u202f For evaluating incapacitation, a reasonable person&nbsp;means a sober, objectively reasonable person in the same situation, with ordinary sensitivities, and with similar identities.<\/li>\n\n\n\n<li><strong>Incapacitation can be voluntary or involuntary.<\/strong>&nbsp;Signs of&nbsp;incapacitation may include, without limitation: sleep; total or intermittent unconsciousness; lack of control over physical movements (e.g., inability to dress\/undress without assistance; inability to walk without assistance); lack of awareness of circumstances or surroundings; emotional volatility; combativeness; vomiting; incontinence; unresponsiveness; and inability to communicate coherently. Incapacitation is an individualized determination based on the totality of the circumstances.&nbsp;<\/li>\n<\/ul>\n<\/div><\/section><\/div>\n\n\n\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>What counts as force?<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Force (Forced)<\/strong>&nbsp;means words and\/or conduct that, viewed from the perspective of a reasonable person,&nbsp;substantially impair(s) a person\u2019s ability to voluntarily choose whether to take&nbsp;an action&nbsp;or participate in an activity. <strong>Examples of&nbsp;force<\/strong> include, without limitation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Physical force (e.g., hitting, punching, slapping, kicking, restraining, choking, kidnapping, using a weapon, blocking access to an exit);<\/li>\n\n\n\n<li>Words and\/or conduct that would cause a reasonable person to fear:&nbsp;<\/li>\n\n\n\n<li>Physical force or other harm to the person\u2019s health, safety, or property, or a third person\u2019s health, safety, or&nbsp;property;<\/li>\n\n\n\n<li>Loss or impairment of an academic benefit, employment benefit, or&nbsp;money;<\/li>\n\n\n\n<li>Disclosure of sensitive personal information or information that would harm a person\u2019s&nbsp;reputation; <\/li>\n\n\n\n<li>Disclosure of video, audio, or an image that depicts the person\u2019s nudity or depicts the person engaging in a sexual act(s); or<\/li>\n\n\n\n<li>Other immediate or future physical, emotional, reputational, financial, or other harm to the person or a third person. <\/li>\n<\/ul>\n<\/div><\/section><\/div>\n<\/div><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h2 class=\"wp-block-heading\">You Are Not Alone<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you or someone you know has experienced sexual assault or other sexual misconduct, you are not alone.
