{"id":108,"date":"2026-01-16T17:00:01","date_gmt":"2026-01-16T22:00:01","guid":{"rendered":"https:\/\/studentlife.utk.edu\/wellness\/?page_id=108"},"modified":"2026-03-25T12:47:25","modified_gmt":"2026-03-25T16:47:25","slug":"sexual-misconduct","status":"publish","type":"page","link":"https:\/\/studentlife.utk.edu\/wellness\/relationship-sexual-violence-prevention\/sexual-misconduct\/","title":{"rendered":"Sexual Misconduct"},"content":{"rendered":"\n<div class=\"wp-block-cover alignfull has-custom-content-position is-position-center-left\" style=\"min-height:202px;aspect-ratio:unset;\"><img decoding=\"async\" class=\"wp-block-cover__image-background wp-image-6180 size-full\" alt=\"\" src=\"https:\/\/studentlife.utk.edu\/wp-content\/uploads\/2025\/09\/Smokey-Gray-Mountains.jpg\" style=\"object-position:50% 65%\" data-object-fit=\"cover\" data-object-position=\"50% 65%\" \/><span aria-hidden=\"true\" class=\"wp-block-cover__background has-background-dim-0 has-background-dim\"><\/span><div class=\"wp-block-cover__inner-container is-layout-flow wp-block-cover-is-layout-flow\"><h1 style=\"padding-right:var(--wp--preset--spacing--large);padding-left:var(--wp--preset--spacing--large);padding-top:var(--wp--preset--spacing--x-small);padding-bottom:var(--wp--preset--spacing--x-small);margin-right:0;margin-left:0\" class=\"has-text-align-left has-link-color wp-elements-2669c25cd1f06430b4b85ebffeced485 wp-block-post-title has-text-color has-white-color\">Sexual Misconduct<\/h1><\/div><\/div>\n\n\n\n<hr class=\"wp-block-separator alignfull has-alpha-channel-opacity\" style=\"margin-top:0;margin-bottom:0\" \/>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-002ffff5 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Sexual misconduct<\/strong>&nbsp;is an umbrella term&nbsp;to describe all forms of conduct prohibited in the university\u2019s&nbsp;<a href=\"https:\/\/titleix.utk.edu\/wp-content\/uploads\/sites\/96\/2021\/08\/2021-22-Title-IX-Policy.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Policy on Sexual Harassment, Sexual Assault, Dating and Domestic Violence, and Stalking.<\/a>&nbsp;The umbrella term\u202f<strong>relationship and sexual violence\u202f<\/strong>may be used interchangeably with&nbsp;sexual misconduct.&nbsp;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-002ffff5 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\" id=\"harassment\">Sexual Harassment <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">According to UT Policy,&nbsp;sexual&nbsp;harassment&nbsp;is conduct&nbsp;on the basis of&nbsp;sex that satisfies one or more of the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An employee of the&nbsp;university conditioning the provision of an aid, benefit, or service of the&nbsp;university on an individual\u2019s participation in unwelcome sexual&nbsp;conduct;&nbsp;<\/li>\n\n\n\n<li>Unwelcome conduct&nbsp;determined&nbsp;by a reasonable person to be so severe, pervasive, and objectively offensive that it effectively denies a person equal access to the&nbsp;university\u2019s education program or activity; or&nbsp;<\/li>\n\n\n\n<li>Sexual&nbsp;assault,&nbsp;dating&nbsp;violence,&nbsp;domestic&nbsp;violence, and\/or&nbsp;stalking.&nbsp;<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"stalking\">Stalking<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Stalking&nbsp;can be represented in many forms. If someone\u2019s&nbsp;behavior makes you feel&nbsp;afraid, vulnerable, unsafe, anxious, or like you need to change locations, routines, or housing, these may be signs of stalking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some examples:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Showing up uninvited to your place of work, school,&nbsp;or&nbsp;home&nbsp;<\/li>\n\n\n\n<li>Knowing your schedule&nbsp;<\/li>\n\n\n\n<li>Repeated unwanted in-person or online contact&nbsp;<\/li>\n\n\n\n<li>Spreading rumors about you&nbsp;<\/li>\n\n\n\n<li>Damaging your property&nbsp;<\/li>\n\n\n\n<li>Using other people to find out more about you (e.g., via a mutual friend\u2019s social media account)&nbsp;<\/li>\n\n\n\n<li>Tracking your movements<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-utk-wds-accordion\"><div data-accordion=\"true\" class=\"utk-wds-accordion-wrapper\" data-color-scheme=\"light\">\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>UT Policy Definition of Stalking<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Stalking<\/strong>\u202fmeans engaging in a course of conduct directed at a specific person that would cause a reasonable person to-<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>Fear for his or her safety or the safety of others; or&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>Suffer substantial emotional distress.&nbsp;<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Course of conduct<\/strong> means two or more acts, including, but not limited to, acts in which a person directly, indirectly, or through third parties, by any action, method, device, or means, follows, monitors, observes, surveils, threatens, or communicates with or about another person, or interferes with another person\u2019s property.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Substantial emotional distress<\/strong> means significant mental suffering or anguish that may&nbsp;but does not necessarily&nbsp;require medical or other professional treatment or counseling. For the definition of&nbsp;stalking,&nbsp;reasonable person\u202fmeans a reasonable person under similar circumstances.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the definition of <strong>stalking<\/strong>, a\u00a0reasonable person\u00a0means a reasonable person under similar circumstances and with similar identities to the complainant.\u00a0<\/p>\n<\/div><\/section><\/div>\n<\/div><\/div>\n<\/div>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" \/>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-002ffff5 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\" id=\"assault\">Sexual Assault<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sexual&nbsp;assault&nbsp;is an umbrella term for any sexual act directed against another person, without consent of the victim, including instances where the victim is incapable of giving consent. Sexual&nbsp;assault includes&nbsp;rape,&nbsp;fondling,&nbsp;incest, and&nbsp;statutory&nbsp;rape.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Rape<\/strong> is\u202fthe penetration, no matter how slight, of the vagina or anus, with&nbsp;any body&nbsp;part or object, or oral penetration by a sex organ of another person, without the consent of the victim.&nbsp;<\/li>\n\n\n\n<li><strong>Fondling<\/strong> is the touching of the private body parts of another person for the purpose of sexual gratification, without the consent of the victim, including instances where the victim is incapable of giving consent because of his\/her age or because of his\/her temporary or permanent mental incapacity.&nbsp;<\/li>\n\n\n\n<li><strong>Incest<\/strong> is sexual intercourse between persons who are related to each other within degrees wherein marriage is prohibited by law.&nbsp;<\/li>\n\n\n\n<li><strong>Statutory Rape<\/strong>&nbsp;is sexual intercourse with a person who is under the statutory age of consent.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Sexual assault is when someone experiences sexual touch or penetration without&nbsp;<a href=\"http:\/\/wellness.utk.edu\/consent\" target=\"_blank\" rel=\"noreferrer noopener\">consent<\/a>.<\/p>\n<\/div><\/section><\/div>\n\n\n\n<div class=\"wp-block-utk-wds-accordion-panel\"><h2 class=\"utk-wds-accordion__heading\" data-accordion-heading=\"true\"><div>UT Policy Definition of Consent<\/div><\/h2><section data-accordion-section=\"true\"><div class=\"utk-wds-accordion__panel-body\">\n<p class=\"wp-block-paragraph\"><strong>Consent<\/strong>\u202fis an active agreement to&nbsp;participate&nbsp;in a sexual act. An active agreement is words and\/or conduct that communicate a person\u2019s willingness to&nbsp;participate&nbsp;in a sexual act.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Examples of <strong>sexual act(s)<\/strong>\u202finclude, without limitation: vaginal intercourse; anal intercourse; oral sex; any other intrusion, however slight, of a person\u2019s finger or any object into any other person\u2019s genitals or anus; the intentional touching of a person\u2019s intimate parts (genital area, groin, inner thigh, buttock or breast), the intentional touching of the clothing covering the immediate area of a person\u2019s intimate parts, or the intentional touching of any other person with a person\u2019s own intimate parts, if that intentional touching can be reasonably construed as being for the purpose of sexual gratification.&nbsp;<\/li>\n\n\n\n<li>Consent can be revoked at any time.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Valid Consent cannot be given if:<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A person is&nbsp;<\/strong><strong>i<\/strong><strong>ncapacitated<\/strong>\u202fand a&nbsp;reasonable&nbsp;person in the same situation as the Respondent would have known that the person is&nbsp;Incapacitated;&nbsp;<\/li>\n\n\n\n<li><strong>A person is&nbsp;<\/strong><strong>f<\/strong><strong>orced<\/strong>; or&nbsp;<\/li>\n\n\n\n<li><strong>The sexual penetration of a person by the&nbsp;respondent would constitute mitigated statutory rape, statutory  rape, or aggravated statutory rape under state law<\/strong>, based on the ages of the Respondent and the other person.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Force (Forced)<\/strong>\u202fmeans words and\/or conduct that, viewed from the perspective of a reasonable person,&nbsp;substantially&nbsp;impair(s)&nbsp;a person\u2019s ability to voluntarily choose whether to take&nbsp;an action&nbsp;or participate in an activity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Examples of Force<\/strong> include, without limitation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Physical force (e.g., hitting, punching, slapping, kicking, restraining, choking, kidnapping, using a weapon, blocking access to an exit);&nbsp;<\/li>\n\n\n\n<li>Words and\/or conduct that would cause a reasonable person to fear:&nbsp;<\/li>\n\n\n\n<li>Physical force or other harm to the person\u2019s health, safety, or property, or a third person\u2019s health, safety, or&nbsp;property;&nbsp;<\/li>\n\n\n\n<li>Loss or impairment of an academic benefit, employment benefit, or&nbsp;money;&nbsp;<\/li>\n\n\n\n<li>Disclosure of sensitive personal information or information that would harm a person\u2019s&nbsp;reputation;&nbsp;<\/li>\n\n\n\n<li>Disclosure of video, audio, or an image that depicts the person\u2019s nudity or depicts the person engaging in a sexual act(s); or&nbsp;<\/li>\n\n\n\n<li>Other immediate or future physical, emotional, reputational, financial, or other harm to the person or a third person.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Incapacitation<\/strong> means that a person lacks the ability to actively agree to sexual activity because the person is asleep, unconscious, under the influence of an anesthetizing or intoxicating substance such that the person does not have control over their body, is otherwise unaware that sexual activity is occurring, or their mental, physical, or developmental abilities renders them incapable of making a rational informed judgment. <strong>Incapacitation is&nbsp;not the same as&nbsp;legal intoxication.<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A person violates this policy when they engage in sexual activity with another person who is Incapacitated&nbsp;under circumstances in which&nbsp;a reasonable person would have known the other person to be incapacitated.<\/strong> For evaluating Incapacitation, a \u201creasonable person\u201d means a sober, objectively reasonable person in the same situation, with ordinary sensitivities, and with similar identities as the Respondent. <\/li>\n\n\n\n<li><strong>Incapacitation can be voluntary or involuntary.<\/strong> Signs of Incapacitation may include, without limitation: sleep; total or intermittent unconsciousness; lack of control over physical movements (e.g., inability to dress\/undress without assistance; inability to walk without assistance); lack of awareness of circumstances or surroundings; emotional volatility; combativeness; vomiting; incontinence; unresponsiveness; and inability to communicate coherently. The primary aggressor will be considered the Respondent for purposes of evaluating Domestic Violence.&nbsp;<\/p>\n<\/div><\/section><\/div>\n<\/div><\/div>\n<\/div>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Recognizing the signs of abuse in intimate relationships can be challenging and painful. Often people&nbsp;assume&nbsp;if there is no physical violence, it cannot be considered abusive. But emotional and verbal abuse can take a significant toll on your well-being.
